Our Commitment to Security & Privacy
We take your trust seriously. Protecting your data, ensuring service reliability, and maintaining transparency are central to how we operate. The following sections explain how we use cookies, how we protect your information, and how third-party dependencies may affect the Service.
1. Introduction
Welcome to Affilio.link (“we,” “us,” or “our”), operated by Ꮶіѕѕ Ре́ṭеŗ e.v., a company registered in Hungary, with its principal place of business at Вսdареѕṭ Ϝоdоŗṃеոṭа ս. 22. We provide a Software-as-a-Service (“SaaS”) platform for affiliate link optimization and monitoring.
These Terms of Service (“Terms”) govern your access to and use of our platform, tools, APIs, and any related services (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree, you may not use the Service.
Data Storage Location All user data is stored and processed in the United States. By using the Service, you consent to this transfer and storage, regardless of your country of residence.
2. Legal Capacity & Authority
If you enter into these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms. In such case, “User” and “you” will refer to that entity.
If you do not have such authority, you must not accept these Terms or use the Service on behalf of the entity.
3. Definitions
- Service – The Affilio.link platform, tools, APIs, analytics dashboard, and any related services we provide.
- User – Any individual or entity that accesses or uses the Service.
- Client – A business entity with one or more associated User accounts.
- Affiliate Link Replacement Revenue – When a broken or inactive affiliate link is temporarily replaced, while deleted affiliate link may permanently replaced with our own, any resulting commission is retained by us. Users will not receive revenue from these temporary replacements. This process ensures continuity of service and avoids user-facing errors caused by inactive links.
- Broken Link – Any link that fails to resolve to an active page or returns an error status (e.g., HTTP 404).
4. Account Registration
To register for the Service, you must:
- Be at least 18 years old or the legal age of majority in your jurisdiction.
- Provide accurate, current, and complete information during registration and keep it updated.
- Maintain the security of your account credentials and notify us immediately of any unauthorized use.
- Be responsible for all activities that occur under your account.
- Not share or transfer your account to another person or entity without our written consent.
We reserve the right to refuse, suspend, restrict, or terminate any account at our sole discretion if we reasonably believe you have violated these Terms, applicable laws, or third-party affiliate program requirements.
Suspension or restriction may occur without prior notice where immediate action is necessary to prevent harm, legal exposure, system abuse, or disruption of the Service.
We shall not be liable for any loss or damages resulting from the suspension, restriction, or termination of your account in accordance with these Terms.
5. Subscription, Billing & Refunds
We offer free and paid subscription tiers: Free, Boost, Professional, and Enterprise.
Paid subscriptions are billed monthly or annually and will renew automatically unless canceled before the start of the next billing cycle.
You may cancel your subscription at any time in your account settings. Cancellations take effect at the end of the current billing period, and you will retain access to the Service until then.
Withdrawal & Refunds: If applicable law grants you a right of withdrawal or refund (for example, for digital subscriptions within a statutory cooling-off period), we will honor that right. If you request immediate access to paid features, you may be asked to expressly agree that your right of withdrawal ends once the service has been fully delivered. Outside of legally required cases, refunds are not provided.
Payments are processed through third-party providers. While we are not responsible for errors or failures caused by these providers, we will assist you in resolving payment-related issues where possible.
Downgrading your subscription plan may reduce access to certain features. Links that exceed the limits of your new plan may be flagged as inactive or archived. Where applicable, such links may be repurposed in accordance with the Link Repurposing Notice, and you will be informed of this effect before confirming the downgrade.
6. Acceptable Use & Restrictions
When using our Service, you agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Violate the terms of any affiliate program you participate in (including, but not limited to, Amazon Associates, eBay Partner Network, AliExpress, etc.).
- Send unsolicited bulk messages (“spam”) or engage in deceptive, misleading, or unethical marketing practices.
- Attempt to circumvent or disable our link replacement logic, tracking mechanisms, or security features.
- Interfere with or disrupt the proper functioning of the Service.
7. User Content & Intellectual Property
You retain ownership of any links, content, branding elements, or data you submit to the Service (“User Content”).
By using the Service, you grant Affilio a non-exclusive, worldwide, royalty-free license to use, process, store, modify, and display User Content solely for the purpose of operating, improving, and providing the Service.
All intellectual property rights in the Service, including software, databases, design, trademarks, and documentation, remain the exclusive property of Affilio or its licensors. No rights are granted except as expressly stated in these Terms.
8. Affiliate Program Compliance & Monetization Transparency
You are solely responsible for ensuring that your use of the Service complies with the terms, policies, and guidelines of each affiliate program you participate in.
To maintain service quality and minimize broken links, we may temporarily replace inactive or expired links with our own affiliate links, which may generate commission for us. Such replacements will be disclosed in accordance with applicable transparency and advertising regulations.
Affilio does not guarantee any level of affiliate revenue, conversion rate, or commission outcome. Affiliate earnings depend on third-party programs and user implementation, which are outside our control.
9. Link Repurposing & User Rights
Certain features of the Service may include the replacement or repurposing of inactive, broken, or archived links. Details about how and when link repurposing occurs are set out in our separate Link Repurposing Notice, which forms part of these Terms by reference.
Opt-out rights:
Free-tier users agree that link repurposing may occur automatically, and cannot opt out.
Paid subscription users may choose to opt out of link repurposing in their account settings. If you opt out, broken or inactive links will remain inactive until you update them.
By using the Service, you acknowledge and agree to the practices described in the Link Repurposing Notice. If you do not agree, you must discontinue use of the Service.
10. Service Level & Availability
- We strive to provide high availability and reliable performance for the Service but cannot guarantee uninterrupted or error-free operation.
- Scheduled maintenance, updates, or any other planned downtime will be communicated in advance whenever reasonably possible.
- The Service’s functionality may be affected by changes, interruptions, or deprecations in third-party APIs (such as Amazon, eBay, AliExpress, and others), which are beyond our control.
- We disclaim liability for any downtime, degraded performance, or data loss resulting from such third-party changes or unforeseen circumstances.
- While we aim to respond to support inquiries promptly, response times may vary depending on your subscription plan. Priority support is provided to paid subscribers, whereas free-tier users have access to community-based support channels.
- We reserve the right to perform emergency maintenance without prior notice if necessary to protect the security or integrity of the Service.
11. Beta or Experimental Features
From time to time, we may offer features designated as beta, preview, or experimental. Such features may be modified or discontinued at any time without notice. They are provided “as is” without warranties of any kind and may be subject to additional limitations.
12. API Terms of Use
- When accessing our API, you agree to comply with all published usage guidelines and rate limits, which may be updated from time to time.
- API keys are confidential credentials and must not be shared, exposed publicly, or used by unauthorized parties. You are responsible for all activities conducted using your API keys.
- You may not use the API to develop, maintain, or operate any competing service or product that replicates or substitutes our core Service functionality.
- Automated or abusive use of the API that negatively impacts service availability or performance may lead to temporary suspension or permanent revocation of access.
- We reserve the right to modify, limit, or terminate API access at our discretion, including adjusting rate limits or feature availability, to ensure fair usage and overall system stability.
- Support for API users is provided according to their subscription tier; paid plans receive direct support, while free users may rely on community forums and documentation.
13. Cookies & Tracking
Our Service uses cookies and similar technologies. Details about the types of cookies we use, their purposes, and how you can manage your preferences are set out in our separate Cookie Policy, which forms part of these Terms by reference.
14. Security & Breach Notification
- We apply industry-standard technical and organizational measures to safeguard your personal data, including encryption, access controls, monitoring, and regular security reviews.
- While no system can be 100% secure, we are committed to maintaining a high level of protection for your information.
- In the unlikely event of a security incident affecting your data, we will notify you promptly in accordance with applicable laws and outline the measures taken to mitigate impact.
- To prevent abuse and protect users, we maintain a domain classification and link verification system. New target links are checked against our internal database. If a domain is not yet classified, the short URL remains in a pending state until verified. For unknown domains, we use third-party threat intelligence services (e.g., SophosLabs Intelix) and, if needed, static URL analysis before activation. We reserve the right to block or refuse links that are determined to be unsafe or malicious.
While we implement reasonable safeguards, no system can be guaranteed 100% secure. You acknowledge that you provide data at your own risk.
15. Third-Party Services & Dependencies
- The Service relies on integrations with third-party platforms and APIs (e.g., Amazon, eBay, AliExpress, payment processors).
- We carefully select reputable providers but cannot control their availability, performance, or policy changes.
- Your use of such third-party services may also be governed by their respective terms and privacy policies, which we recommend you review.
16. Export Controls & Sanctions
Our Service is subject to applicable export control laws and trade sanctions.
You may not access or use the Service if:
- You are located in, or ordinarily reside in, a country or territory subject to comprehensive trade sanctions, or
- You are listed on any government-issued sanctions or restricted parties list.
By using the Service, you represent and warrant that your access complies with all applicable export control and sanctions regulations.
Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Hungary, without regard to conflict of law principles. If you are located outside of Hungary, you agree that any disputes arising out of or in connection with the Service will be subject to the exclusive jurisdiction of the courts of Hungary.
If you are a consumer located in the European Economic Area (EEA), you may also benefit from mandatory provisions of your local consumer protection law.
17. Age Restrictions
The Service is intended for use only by individuals who are at least 18 years of age, or the minimum legal age of majority in their jurisdiction (whichever is higher).
By creating an account, you represent that you meet these requirements.
We reserve the right to request proof of age and to suspend or terminate accounts that violate this requirement.
18. Data Retention & Deletion
Upon termination or cancellation, access to the Service will cease. We may retain certain data as required by law, for legitimate business purposes, or as described in our Privacy Policy. We are not obligated to store User Content indefinitely and recommend exporting necessary data prior to termination.
19. Termination
We reserve the right to suspend or terminate your account, with or without prior notice, if:
- You materially breach these Terms,
- You engage in illegal, abusive, or fraudulent activity, or
- You fail to pay applicable fees.
Upon termination, your right to access and use the Service will cease immediately.
We may retain certain data for legal, regulatory, or operational purposes, in accordance with our Privacy Policy.
Termination does not affect any accrued rights or obligations up to the date of termination.
20. Disclaimers & Limitation of Liability
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Affilio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Service shall not exceed the total amount you paid to us for the Service during the twelve (12) months immediately preceding the event giving rise to the claim.
21. Indemnification
You agree to defend, indemnify, and hold harmless Affilio, its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your violation of these Terms,
- Your breach of applicable affiliate program rules or third-party terms, or
- Your misuse of the Service.
22. Force Majeure
We shall not be held responsible or liable for any delay, interruption, or failure in performance resulting from events beyond our reasonable control, including but not limited to acts of God, natural disasters, power failures, strikes, labor disputes, government actions, war, terrorism, or interruptions in telecommunications or internet services.
23. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate restructuring, or sale of assets.
24. Confidentiality
Each party may have access to non-public information disclosed by the other party that is designated as confidential or that reasonably should be understood to be confidential under the circumstances (“Confidential Information”).
Confidential Information includes, but is not limited to, technical data, product plans, pricing information, security measures, business strategies, and non-public user data.
The receiving party agrees to:
- use Confidential Information solely for the purpose of performing its obligations or exercising its rights under these Terms;
- protect such information using reasonable administrative, technical, and organizational safeguards;
- not disclose Confidential Information to any third party except to employees, contractors, or advisors who are bound by confidentiality obligations.
Confidential Information does not include information that:
- (a) is or becomes publicly available without breach of these Terms;
- (b) was lawfully known prior to disclosure;
- (c) is independently developed without use of Confidential Information; or
- (d) is required to be disclosed by law or court order.
25. Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will notify you by email, in-app or dashboard notification, or other reasonable means at least thirty (30) days before the changes take effect.
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service before they become effective.
26. Copyright Complaints
Affilio respects intellectual property rights. If you believe that content or links submitted through the Service infringe your copyright, you may submit a written notice to: legal@affilio.link.
Your notice must include:
- identification of the copyrighted work claimed to be infringed;
- identification of the material claimed to be infringing;
- your contact information;
- a statement that you have a good faith belief the use is unauthorized;
- a statement that the information in your notice is accurate;
- your physical or electronic signature.
We may remove or disable access to allegedly infringing material and may terminate repeat infringers in appropriate circumstances.
27. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be interpreted or modified to the minimum extent necessary to make it enforceable while preserving its original intent.
28. Waiver
The failure of Affilio to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Affilio.
29. Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, and any applicable subscription agreement or order form, constitute the entire agreement between you and Affilio regarding the Service and supersede all prior or contemporaneous agreements, understandings, or representations.
30. Governing Law & Dispute Resolution
These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of Hungary, without regard to conflict of laws principles.
- EU Users: Disputes shall be submitted to the exclusive jurisdiction of the competent courts in Hungary.
- Non-EU Users: Disputes shall be resolved through binding arbitration seated in Budapest, Hungary, in accordance with the Rules of Arbitration of the Hungarian Chamber of Commerce and Industry. The arbitration language shall be English.
